Independent Police Force (Terrifying)

Former Senator and Health Minister Stuart Syvret was jailed yesterday (2nd November 2011) apparently for not complying with his Community Service order. This of course is the line taken by Jersey's State Media. However, as is so often the case, the State Media are being a little economical with the full facts.

From the very start Mr. Syvret claimed that the prosecution against him was "a criminal enterprise." After being sentenced to the 80 hours Community Service he claimed to have received evidence, in the form of Former Jersey Police Chief Graham Power's, submission to the Wiltshire Constabulary's DISCREDITED REPORT. Mr. Syvret also claimed that a witness, known to the prosecution, was kept from him which he claims hampered his case.

We are led to believe Mr. Syvret applied for a court hearing to submit all this new evidence but this was denied him by Mr. William Bailhache (Deputy Bailiff) who's brother Philip Bailhache (Former Bailiff) was running against him in the Jersey elections.

Mr. Syvret claims since he was refused this court hearing then he was forced not to comply with his Community Service Order so as he would get brought back to court where he could then submit this new evidence that he claimed to prove the prosecution against him was indeed criminal. However, rightly or wrongly, the Magistrate's Court refused to hear any of this new evidence and jailed him for eight weeks.

But there does appear to be a common thread running through all of this and that is "Child Abuse."  Mr. Syvret was the first politician to speak out against Jersey's Child Protection Failures back in 2007 and as a result of this there is strong evidence to suggest that his removal from office (Health Minister) was engineered by, among others, the very Civil Servants, who he claimed were responsible for these failures.

At the same time as the Former Health Minster was publicly condemning Jersey's Child Protection Apparatus, unknown to him, there was a covert police investigation into Institutional Child Abuse ("Operation Rectangle") in progress headed up by the then Deputy Police Chief Officer Lenny Harper. This was possibly the biggest investigation ever undertaken by a Jersey Police Force where a number of the suspects were people, known as "The Establishment" people who wielded a lot of power and influence in Jersey.............That were never charged.

The rest is well recorded (by Bloggers) History, out of the 151 suspects only a mere 8 of them were ever charged, by what is strongly believed to be a politicised Judicial system where the public were only given a couple of SHOW TRIALS.

The then Chief of Police Graham Power QPM was, "Dubiously"  suspended from duty, Lenny Harper retired, and the State Media went about trashing their names and reputations. All the focus seemed to shift from the Child Abuse that was able to flourish for decades in Jersey's "care" homes onto how much Lenny Harper spent on a Prawn Cocktail in a Bombay Brasserie. The State Media have never set about asking how paedophiles could ply their trade in Jersey's State Run institutions for so long without detection. Indeed the State Media haven't set about asking many questions at all they just repeat, broadcast, publish or print the Press Releases they are given by the State regardless of how preposterous they are.

Below we have part two of Mr. Syvret's evidence given to the Education and Home Affairs Scrutiny Sub Panel (parliamentary Select Committee) who are investigating issues surrounding the Review of financial management of "Operation Rectangle."

We must remember the "State Line" is that Lenny Harper and Graham Power became, overnight, terrible cops who must have completely forgotten all their police training as soon as they started to investigate Child Abuse in Jersey. Or is it, as Mr. Syvret claims in his evidence to Scrutiny, that Mr. Harper and Mr. Power were two straight cops who were going to investigate without fear or favour? Is the truth of all this that these two cops were truly independent and this "terrified" the Jersey Establishment? Is Stuart Syvret spending 8 weeks in prison because he blew the lid off of the Child Abuse atrocities in Jersey? Have the reputations of Lenny Harper and Graham Power QPM been trashed by the Jersey Establishment (and their media) because they blew the lid off of Jersey's "Dirty Secrets?" Has the Home Affairs Minister, Senator Ian Le Marquand, fulfilled his wish and brought the police back under Political Control? Does anybody remember that amongst all this are people who suffered at the hands of paedophiles in State Run "Care" Homes FOR DECADES?

The views expressed by the witness are his own and not necessarily shared by VFC.

  2. Graham Power Lenny Harper and Stuart Syvret all spoke out against the child abuse and look how they've been treated since. Jersey is one corrupt island.

  3. Even if every claim he ever made turns out to be true, even if every person he ever insulted deserves it, even if Harper & Co. are proved to be justified in their complaints or if every person accused of being an abuser is convicted.

None of this would make any difference to the fact that he has been found guilty of Contempt of Court, because he failed to conduct himself as your and my laws dictate he should.

It's a shame for him that he didn't understand this, but whoever you are, and whatever your claims, you can't pick and chose which laws you obey and which you don't.

  4. How right you are VFC.

Stuart Syvret has been jailed for exposing Child Abuse failures, and being too honest and outspoken.

That is the bottom line. I am ashamed to live here.

  5. I think Mr. Syvret understood clearly how Jersey Law would treat him the way it wanted to not the way Law intended.

Sadly those laws would not allow Mr. Syvret to defend himself.

  6. What happened to the case of Ian Mr. Christmas.

Was he not appealing evidence being withheld from his case? It would be interesting to know how that resolved itself.

  7. "None of this would make any difference to the fact that he has been found guilty of Contempt of Court"

That is nonsence. Of course it would, because it would quash the false judgement of Contempt of Court.

Stuart has not committed Contempt of Court, if anything, he has shown passionate respect for the law, by refusing to take the easy and more cowardly option - which I would have taken and which I advised him to take - of accepting the community service sentance he was given, following a farcicle and lob sided illegal trial.

I am gutted that he is in prison right now, but I feel proud to know such a high principled man.

Stuart has not committed Contempt of Court, but Bridget Shaw has brought the Court into disrepute by her actions, and therefore it is she who has really committed Contempt of Court.

That is ultimatly how history will judge it!

They've done their best to misrepresent him and cover up his points of view, ignore him wherever possible, but as soon as the corrupt courts get their way, they scream -

    oh dear more uninformed tosh,

data protection regulations are enactments not law, if they were law they would be called law not enactments

enactments do not apply to men and women.

contempt of court must be either criminal or civil eg there must be a victim for criminal contempt and a contract that has been breached for civil contempt.

    Stuart Syvret broke no laws

Shaw,Baker et al are guilty of constructive fraud

for your information anon, my law and the only man made law that applies to me is common law.

Data Protection Law (Jersey) Law 2005. It seems to be called a law to me.

Your playground legal argumnts worked brilliantly for your client I see.

But of course like most internet legal experts, you know better than the people who actually practice it for a living, so I look forward to your tedious explanations of why criminal law doesn't appply to you. (Unless of course you are the victim of a criminal, in which case I'm sure you'd come running back into the fold).

  15. The origins of Jersey law

In order to understand the development of Jersey contract law it is necessary first to examine the origins of Jersey law as a whole.

The common law (or customary law) of Jersey is based upon the customary law of the ancient Duchy of Normandy. Despite the fact that the English sovereigns ceased to be Dukes of continental Normandy in 1204, the Channel Islands remained attached to the English Crown. However, Jersey still retained its ancient Norman law, except in so far as it had in the course of time been modified or corrupted by subsequent enactments or usages.

    Laypersons observation.

I believe Stuart was not contracted or consent to be contracted.

This is not correct. Only 4 of the 151 were ever charged making the true statistics even more alarming!!!

    The four are:
    Gordon Wateridge
    Anthony and Morag Jordan
Michael Aubin (himself a victim of abuse whilst in the care of the SofJ)
The others convicted were not related to HDLG or other care homes in Jersey.

  23. I posted a letter to Stuart, please will you tell him, so that he knows, I want to make sure he gets his mail.

I think anyone writing to Stuart ought to send handwritten letters, with their signiture, rather than typed out. The reason for this is that the scum have a trick of identity theft, they have pretended to be someone else and written nasty letters to people to pit one person against another. If we write letters in our own hand rather than type it, then it makes it virtually impossible to get away with that sort of nonsence.

Please give him regards from his supporters in Staffordshire

The whole situation against Stuart has been unlawful and politically motivated by a bent system. He's a champion for fighting the corruption.

He wouldn't have to "choose which laws suit him" if the law was fairly applied in the first place!

JERSEY AND THE IMPRISONMENT OF STUART SYVRET

    3:11:11

    John Hemming

    * 1

That this House notes the imprisonment of Stuart Syvret; believes that the public authorities of the island of Jersey do not operate in a manner compliant with the requirements of the European Commission of Human Rights (ECHR), there being overt and significant overlaps and contaminations between the legislature, executive and judiciary; further notes that Her Majesty's subjects in Jersey are not protected by effective checks and balances, and that there has been the political repression of former Chief Police Officer, Graham Power and former Senator Stuart Syvret; further notes that, notwithstanding the responsibility the Secretary of State for Justice has for good governance and Convention Rights in Jersey, the island's authorities are permitted to repress opposition activists, and that the Secretary of State for Justice and Jersey's Lieutenant Governor have failed to act; further notes that successive governments of the United Kingdom have committed this nation to securing real democratic freedoms and the rule of law in other jurisdictions, yet in the British enclave of Jersey on the United Kingdom's very doorstep, ordinary powerless people are oppressed by an entrenched oligarchy; and calls on the Secretary of State for Justice to appoint an independent Commission similar to that which investigated corruption in the Turks and Caicos Islands, to investigate the conduct of Jersey's public administration and to urgently bring the protections of the ECHR to Her Majesty's subjects in the island.

  39. Just back from attending this mornings court proceedings.

Peter Harris was the Magistrate - at least he was far less patronising than Bridget Shaw and seemed to have more patience.

Amongst several cases called before Stuarts were two where community service orders had not been complied with, one of which was for 134 hours with 11 further serious charges as well. In NEITHER case were the defendants sent to prison.

So there we start with 'one rule for Stuart and one rule for everybody else'.

One of the charges against Stuart was dropped, and the other which was failure to register with the Data Protection Offices adjourned for 4 weeks. Stuart quite rightly questioned why it was he alone who was being pressured to register when this did not apply to other bloggers. Again 'one rule for Stuart.....' Are you getting the picture now?

Stuart also requested fuller disclosure of documents which Baker had not provided him with in full when he had asked previously. In fairness to Magistrate Harris, he did say that if Baker accused Stuart of delaying matters further if Baker did not make the disclosures, the matter could be referred to him.

Personally I think it is always good to have a presence in the Court on these occasions, if only to hear first hand just what is said, and also to see the unjustifiable double standards that apply.

It will be interesting to see what the JEP report, as their reporter left before Stuart appeared, which just left the BBC reporter remaining who did more doodling than writing!

Good on John Hemmings - the pressure will now be on from several quarters.

As for Hemming, I also trusted him, a few years ago, when he was posting on the Mothers for Justice forum. I stopped trusting him after two years of more or less non stop verbal abuse, on account of me posting the truth about the two paedophiles who invented Parental Alienation Syndrome and False Memory Syndrome, which the secret family courts are using. Hemming is a gatekeeper. You should wise up to their tricks.

  43. Zoompad,

No disrespect to you but John Hemmings early day motion is good for us here in Jersey. Ok so it might not generate enough MP support to bear any fruit this time (not forgetting the FACAW filter) but at least it’s a start.

From the little I know about JH, he seems like a good MP. Perhaps there are 1 or 2 cases such as yours where opinions differ but in the main..... he is an ally to SS and it would be helpful to remember this at this time. We need solidarity. You've made your point. That’s good, and you can put your name to it.....
you are lucky. In Jersey only the very very very brave do that.

This is an important moment. It may not (yet:) result in the outcomes we're hoping for but it certainly adds weight to the day when the critical moment comes.
So lets try and stay focussed please. There is a lot of work to be done quickly so that we can make the most of this opportunity. We must do this for Stuart, Graham, Lenny, all whistle blowers and above all, the survivors who were abused in Jersey. Beyond that there are other beneficiaries like the little folk but that will be a subsequent gain, not the primary one.
Thank you for supporting a desire for genuine Jersey justice and the exposure of genuine Jersey corruption.

  48. Anonymous,

I have been unfairly portayed as a ranting nutter who falls out with people at the drop of a hat. I don't really care what people think of me personally though, I have too tough a hide to care now, after so many years of abuse, first as a child and then the malicious vindictive persecution that all of us Pindown victims seem to suffer, which my late solicitor Richard Wise (a very good man who Stuart so much reminds me of) was trying to stop, he was getting Pindown survivors out of prison, they were being deliberatly criminalised.

I have a selfish reason for being interested in the Haut de la Garenne child abuse, which I have never tried to hide. What was going on at Haut de la Garenne was also going on in the hell hole that I was put in as a "place of safety". In Jersey is was called the Grand Prix system, in Staffordshire and the rest of the UK it was Pindown.

The Staffordshire Pindown abuse was covered up. I am determined that the Haut de la Garenne abuse will not be.

Stuart Syvret is one of the best men I have ever known. He deserves all the support we can give him, because the only reason he is sitting in a prison cell right now is because he has tried to help people like me, victims of Pindown. This is why I am so determined not to see him stitched up, as I have been, by John Hemming and his cronies.

I won't say any more about John Hemming, I have already told that man exactly what I think of him at Stoke two weeks ago, and on my blog I have posted the reasons why.

I am sorry, but it looks like you are going to have to find out from your own bitter experience what sort of person he really is, for I fear you won't believe me. I just hope that you will all watch your backs.

  50. The excellent blog treasureislands.org has coverage of this, now.

Stuart knows the outside world will pay more attention to his courtroom statements now that he is behind bars. No country can persecute a citizen the way Jersey has Stuart without risking embarrassing outside media exposure.

Those of us outside Jersey can't imagine criminal charges stemming from a tardy drivers license renewal and a courageous exposure of a corrupted murder investigation being used as excuses to jail a blogger.

Local thugs may call him a deserving criminal because Stuart refused to accept ridiculous rulings from a corrupted court, but the outside world will not accept the legality of the original police raid on his home, the crooked court rulings and the denial of his human rights. The Magistrate Shaw has dug a deeper hole for Jersey's reputation at a time when all eyes are on finance industry corruption. Stupid!

He doesn't need to and won't (by the State Media) be asked to. He puts out a Press Statement and the State Media repeat it no questions asked. That's how this administration has been able to get so out of control, no matter what they do/say (65 children's teeth falling through a gap in the floorboard) they don't get challenged.

When have ANY of Jersey's State Media asked how it was possible for children to be abused for decades in Jersey "care" homes? They're not here to challenge the government......they'e here to enable them.

    ReplyDelete
  65. VFC, that is exactly why we are attempting to draw greater international attention to the Jersey situation. I am hopeful that you will see an increase in your international blog stats.

There are reasons to be hopeful.

As I visit bookstores when I travel, I see that most big chain bookstores and independent retailers alike are carrying the Nick Shaxson book in stock. In various Barnes & Noble stores last week, several copies were on hold or back order, and ones on the shelf were still selling briskly. They are linked in displays to the Occupy movement, and are selling the most on college campuses. Treasure Islands is now required reading for a great many classes, probably hundreds of classes, as it is featured alongside text books at campus bookstores. Classes featuring the book, which I know about first hand, include Corporate Sociology, Finance, Economics, Poly Sci, and Journalism.

Also positive is the reason the initial HDLG news was huge worldwide. People do care. The media follow-up may have gone quiet, but almost everyone remembers something about that being a horrendous abuse story, and practically no one outside Jersey would be exposed the local State Media cover-up efforts. That means that only the original scandal is even remembered outside Jersey. So, the cover-up did not help Jersey's reputation, and the real abuse scandal is still identified with the island.

The right to free political speech on the internet is considered almost sacred by the young, and the web makes international borders useless barriers against truth. Jailing Stuart should attract much more attention to the Jersey human rights situation.

Regarding the very real risk to you and these vile threats, probably your best insurance is the outside focus on Jersey. The thinly veiled accusation above, of some sordid secret relationship with Stuart, seems particularly unsophisticated and juvenile, but no one here would discount the terrible risks you take for speaking out truthfully in Jersey. Be safe.

Because I have a quite a few letters from David Hanson, he is the man Lord Falconer passed me on to when he was head of the MOJ, I kept writing to Falconer, then Jack Straw and Bridget Prentice, to ask them why they were allowing a syndrome that was invented by an American paedophile to influence the secret family courts.

If Tim Hanson is anything to do with David Hanson then I have absoolutly no doubt at all that he will have a dossier on you, VFC. He will have one on all of us.

Only there is a Tim Hanson who is with something called THE MOTLEY FOOL, and it seems to have two different registered addresses and I didn't think that was legal.

  69. Tim Hanson is a Lawyer who has done some outstanding work in protecting our children and instigated a Serious Case Review (SCR). He, and his Law Firm, have campaigned in Jersey Courts to try and get children some kind of rights and protection over here.

You can take a look at some of his work, including the SCR, HERE.

To the best of my knowledge he is one of the good guys.

  71. Well, why has that threatener come on here and say he has a file on you?

Sorry, but I have got my Miss Marples head on now. I used to think John Hemmings was good, but those two years of vileness on the MFJ site cured me of that delusion. He was not helping any of us mums on that site, it was just a smokescreen and I wont ever forget how they all treated me, for posting the truth about FMS and PAS.

I have just had a quick peep at the Hanson Renouf website. I see that they have Barbara Corbett as a partner. Why is she using PAS in the secret family court cases she is involved with? Has nobody informed her that PAS was invented by an American paedophile called Richard Gardner? He and Ralph Underwager set up the False Memory Syndrome Foundation, that Richard Webster was involved with. Remember Richard Webster? You should, as he David Rose and Bob Woffingden discredited Lenny Harper's police investigation of HDLG!

But Stuart Syvret is the real thing. He really does genuinly care about people who have been abused.

That's why he is not being praised up to the sky like Hanson Renouf are.

That's why he is in La Moye prison!

Yes, I know, I went through all this for 7 years. My son was appointed one of these lawyers, BUT HE WAS NOT ALLOWED TO MEET HIM ONCE, NOT EVEN ONCE, DURING THE 18 MONTHS HE "WORKED" FOR MY SON, SUPPOSEDLY REPRESENTING HIM!!!!

  79. From Rico's Blog.

Her claims came as Jersey's minister for child welfare was facing accusations of sabotaging the inquiry into child sex abuse on the island.
Ben Shenton sent an email to cabinet colleagues ridiculing the investigation and mocking Lenny Harper, the policeman in charge."My wife keeps referring to Lenny Harper as Lenny Henry - I don't think she's far wrong," said the health and social services minister in his extraordinary message.
Mr Shenton questions whether Mr Harper - Jersey's deputy chief police officer - has ever been investigated for "adult abuse".

He ridicules the idea that the remains found last week beneath the Haut de la Garenne children's home belonged to a child rather than to animals.
And he attacks Wendy Kinnard, a fellow senator whose home affairs ministry oversees the police in the Crown dependency."Wendy, why was it announced to the media that a child's body was found when this was not the case?" wrote Mr Shenton."Why have you allowed your ministry to be run in such an unprofessional and shameful manner?"He claims that one sex abuse victim, purportedly interviewed by The Times this week, died last year.More than 160 others have told police they were abused at the "Colditz" care home between the 1950s and its closure in 1986. At least 40 suspects have been identified.

Press conference: Deputy chief officer Lenny Harper answers questionsWhen the Daily Mail confronted Mr Shenton, a 46-year-old father of two, about his email, sent three days ago, he said: "It was an internal email. I'm just trying to get at the facts."
He dismissed his comparison between Mr Harper and Lenny Henry the comedian as "a slip of the tongue".But Mr Harper, who moved to Jersey six years ago after serving with distinction in the Metropolitan, RUC and Strathclyde police forces - said he was taking the slurs seriously.
He plans to seek legal advice with a view to a libel action and warned that the email could be "a godsend" to defence lawyers when charges relating to the investigation are laid.
"The letter is rather childish but it's a clear attempt to damage the inquiry and therefore damage the interests of all those who were abused in that home," said the 56-year-old officer.
"You may well ask why the very man responsible for children's welfare on this island would wish to sabotage the investigation.
"That is for him to explain but all I can say is that it will not work. Nothing will distract me from getting justice.
"They deserve much better and I am determined they will get that from the State of Jersey police."
Mr Harper is said to have upset leading Jersey figures by briefing journalists on his investigation.
But he said the Association of Chief Police Officers had endorsed his methods which had also led to a large number of alleged victims coming forward.
The abuse scandal is a deep embarrassment to the tax haven island where privacy and discretion are paramount.
•The chief minister of Jersey was facing calls to resign last night.
Five groups demanding the removal of Frank Walker over his handling of the Haut de la Garenne inquiry have appeared on the Facebook networking website.
He is likely to face further criticism in a rally due to be held in the capital St Helier this weekend calling for a change in the way the island is run.

  80. Does anyone know how Tina is? Has she ever been allowed to speak about the abuse she suffered on national media

If I were her, I would be really wanting so much to have my say.

This is what I find really sinister. So many people came forward, and I know from experience that Pindown survivors want to talk and talk about how they were treated. But why are none of the television people allowing us to do so?

I have been nagging to be allowed to go on telly for years, I suspect that other Pindown survivors have too. I was really upset not to be invited on that program about Staffordshire Pindown that Neil Morressey was in. The television people all know about me, and I have even written and published a book about my experiences in "care" (TIP by ZOOMPAD) but noone will let me speak! I was at the same school as Carol Ann Duffy the Poet Laureate, Stafford Girls High School, and the local literary festival snubbed me, they didnt want me there, my book has been removed from our local library, all 4 copies, and they were not even lending it out to people who were asking to borrow it at one point.

It is horrible to be treated like that. Some days you wonder wether you actually exist!

  81. I am very worried about all those over 160 people who came forward about being abused at Haut de la Garenne. It's too easy to make people dissapear.

The Staffordshire Pindown victims, they have done everything they can possibly think of to keep us all apart. My solicitor Richard Wise was bringing us together, but he's dead. He did not die the wa=y the newspapers said at all, they said he was ill for a long time, that is codswallop. He was bounding up thed stairs like an antelope when he took me to his Stoke on Trent office for the first time. He was a picture of health and vitality! He was a marathon runner as well. No way was he ill for a long time. He suddenly got ill, about 2 weeks before he died, and he looked bloody awful, his face was a funny colour. Up till then, he was a picture of health.

This is a link to my book, I changed all the names in it, as at the time I was so scared about being sued. I'm not scared of that at all now, as anyone who wanted to sue me would have to admit that they recognised themselves in the book! My mum has forgiven me for writing it, she has come to terms with it all, thank God. I never meant to humiliate her or my dad or to blame them, but I was simply trying to survive, thats the only reason I wrote this book, survival. Mum was really upset about it at first, but now she is not. I think she's actually proud of me for standing up to the bullies! I gave Stuart a copy when we met up at the Magna Carta.

  83. The way I read it this blog is being selective with the truth as well as the media then. But come on can you seriously support anybody who behaved like Syvret in the Magistrates court not just on Wednesday but over the past couple of years? I think his attitude to the legal system has been terrible and I do want any of my kids taking this self destructve route like he has? Over my dead body.

    ReplyDelete
  84. i 100% believe Stuart Syvret has acted in the only way he felt able.

Especially given the circumstances he has had to deal with, such as failure of disclosure he requested and was entitled too, to defend himself.

    ReplyDelete
  85. It amazes me how some people dismiss the reasons that Syvret has given for his actions, even when others like Graham Power, Lenny Harper, Paul Le Clair to name but a few have stated things that give Stuart's reason some strong credence.

Those who do doubt, should ask themselves, why would a man who has worked relentlessly for twenty plus years, father of the house, who has no other income to support himself with, no business in which to divert his attention to or earn an income from, who was one vote away from being made Chief Minister, why would such a man put himself through such hell and why would such a man be unfairly reported upon in contrast to those who should know better, if you don't know, then clearly you have not done your homework, or you are a peado supporter, or a media brainwashed zombie!!

The issue Stuart is fighting against is not whether a change of address was reported, or the oversight of a driving licence renewal or contempt of court, its far more serious than that, so serious that those against him will at times try like children to intimidate those who support Staurt's goal.

How stupid, but then a stupid person cannot act wise, whereas, a wise man can act the fool, so if anyone thinks Staurt is a fool, then he's played it well, why?, I guess to obtain more evidence.

    ReplyDelete
  86. 'I think his attitude to the legal system has been terrible and I do want any of my kids taking this self destructve route like he has'

I think that if you had made the effort to attand any of the Court hearings that Stuart has been part of, the obstructions he has been up against and the quite clearly biased manner that Bridget Shaw has treated him, you would probably have the same attitude as Stuart, but the difference would be that you would not have a) the courage to do anything about it or b) the wherewithal.

And indeed I would be proud of my children for standing up for what they knew was wrong and corrupt which is just what he is doing.

He has seen what is wrong with the 'system' here, and is determined in his quest. This is not just about him, or the abuse survivors - it goes far deeper.

Maybe one day we will all benefit from his stance.

  94. Sorry but this is NOTHING to do with historic child abuse, its down to Stuart Syvret breaking the data protecion law for publishing a police report about an alleged serial killer, motoring offences and then shunning the justice system afterwards. This constant crap about him being persecuted for exposing child abuse has not one thing to do with his contempt of court or the whole case. If he had never broke the data protecion law or motoring law to start with he would not be inside right now.

I don't think it matters if he comes out tommorrow. He's being treated well, and at least he'll have a good rest, from all the horrible horrible relentless abuse he has had to put up with from the vile people who are in power. I was worried about his health, because it must have been dreadful to live with, that constant and relentless (not to mention illegal) bullying. I expect there are people in prison who have been abused, and they will probably tell Stuart a lot of intersting stuff that he may not have found out otherwise.

    ReplyDelete
  110. "I feel sorry for some of the views on here because legally they are well of the mark at the best of times."

And pray tell, what do you know about law?

You can keep on appealing as long as there are grounds for appeal! In this case there are numerous grounds for appeal, the first being that he was denied a trial by a jury of his peers.

Secondly, he was denied being dealt with as a common law man in a common law jurisdiction.

Thirdly, Bridget Shaw acted contrary to her Oath of Office which means she has forefitted her right to be a judge.

    The list is virtually endless....

    ReplyDelete
  111. Coming from a country which imprisons a disgracefully large percentage of the population, I can pretty much promise no one has ever been imprisoned for blogging about a prematurely closed secret investigation of a likely serial murderer. People are falsely imprisoned all too often, but the public outcry against a warrantless arrest and high power home raid, especially on a dissident politician, would be a human rights outrage on an international scale. If people were imprisoned for failures to update their drivers licenses, when no fatal accident was involved, we would have too few outsiders left to guard the inmates. Surely the bizzare facts of Stuart Syvret's shocking legal suppression are not lost on so many?

Perhaps you haven't noticed that Jersey law is not being lawfully applied because in Jersey, some are more equal than others.

So whoever you are, it just won't wash. Thanks to the internet, oppressed groups such as us (Anonymi Jersey) now have a collective voice. We won't tolerate Jersey corruption any longer. We've had enough....GET IT. We will not shut up....GET IT. This will never go away until after pay back time.

Jersey and other tax havens are not very popular at the moment. And thanks to the internet, the world spotlight will focus on this case whether you like it or not.

I can see many parallels and overlap with Julian Assange's address at the Occupy London Stock Exchange ....
"This movement is not about the destruction of law, it is about the construction of law."

And I, for one, would not have had a judgemental word for him if he had. Stuart has already done so much for the victims of institutional Pindown abuse, not only in Jersey but all around the world, with the amazing battle he has waged against child abuse and corruption all these years.

If he had won a lawsuit and gone off triumphant into the sunset I could only have felt happy for him, and relief that at least he wasn't being persecuted and insulted any more.

I feel grief and rage every time I read those vile and illegal comments (The Nutter ect) that are being written about him. He's done absolutly nothing wrong to deserve to be treated like that!

You don't understand anything about anything if you think you can pull off your stupid "divide and conquer" tactics any more Troll. It's over. You have lost, accept it and repent.

    ReplyDelete
  122. "Surely the bizzare facts of Stuart Syvret's shocking legal suppression are not lost on so many? "

You are making the mistake of assuming that we all live in a free and fair society.

In such a wondeful world, the disgusting way Stuart Syvret had been treated (for standing up for victims of institutional child abuse) would be headline news on every newspaper in the UK.

Sadly, not only do we have lawyers gagging the freedom of the press, there is also rather a lot of jiggery pokery going on with Internet access as well. Some of us have been complaining about strange things happening to our social networking accounts for some time now. For example, I had a message from someone about a week ago from a friend of mine, who thought my Youtube channel had been closed down, as he was no longer able to access it. There's all sorts of strange things going on, people being blocked from messaging other people. I have not been able to post on Robert Green's blog for at least 6 months now.

What he didn’t say is that he; himself was probably up there dumping the 94 page submission to Wiltshire from Graham Power QPM given to Mr. Gripton over a month ago by Stuart Syvret.

    ReplyDelete
  129. As most will be aware by now Stuart Syvret has lost his appeal so has gone back to prison to finish his eight week sentence.

Will wait and see/hear what the State Media have been told to report and the bet is NONE of them mention anything about alleged perjury.

  133. How has Stuart been accused of committing perjury ?

No, that’s why the State Media haven’t and won’t report it. The State Prosecutor Stephen Baker was by Stuart Syvret.

Stuart had, on a number of occasions, requested disclosure of the Former Police Chief’s Mr. Graham Power QPM, 94-page submission to the Wiltshire Constabulary. Mr. Baker had refused disclosure of this document claiming after reading it there was nothing relevant to the case contained in it.

Weeks later Mr. Baker said that he HADN’T read it! So only being a layman that appears to be perjury but I stand to be corrected.

Stuart Syvret has obtained a copy of Mr. Power’s statement to Wiltshire and claims it is indeed relevant to his case, indeed he goes further to say it is “crucial” Stuart did not obtain this statement from the prosecution, it was “leaked” to him.

Jon Gripton, editor of BBC Jersey, has had a copy of Mr. Power’s statement for over a month and not reported a single word of it.

It’s only a matter of time before this document makes it’s way to the internet, at least then Advocate Baker will be able to get a read of it!!

    ReplyDelete
  134. "Weeks later Mr. Baker said that he HADN’T read it! So only being a layman that appears to be perjury but I stand to be corrected."

Not by me, becsuse that sounds like perjury to me as well! And that is a criminal offence, wheras Stuart's origional offence, which was not deliberate but due to forgetfulness, and which was obtained by an illegal warrentless fishing expedition involving 10 police officers raiding his home was a civil offence.

So if Stuart was given two months in prison, by the same scale of judgement, surely Stephen Baker should get at least two years!

  135. Not a single word about the alleged PERJURY......State Media.

    Publish this is you dare!

  138. “Glad to see an eminent UK jurist has shown the paucity of syvret's intellectual argument today.”

Shouldn’t the same “eminent UK jurist” have mentioned anything about the prosecution’s alleged perjury while he was at it?

    ReplyDelete
  139. "I am surprised you people even believed this law breaker had a chance today. "

Perhaps some may have been over optimistic, but par for course was he wouldn't. However at least he hasn't committed a far more serious crime of perjury!!

I cannot wait for the full Wiltshire report so we can all read the evidence that Stuart was not given access to when he needed it to prove his case!!

Why does Stuart do this to himself, I guess its not to further his career or embellish his bank account or gain the popular vote, it must be to fight for change in how the courts are run!!

Trust the old bumbling hamster to come out with one of his typical statements, which in essence is partly true, however I guess if anyone asked bumble to explain why certain ECHR has not been followed in various court appearnaces by Stuart, he would go silent and not know what anyone was talking about.

    ReplyDelete
  140. Ah yes - THAT perjury which I was witness to on both the occasion Baker said there was nothing of relevance in Mr Power's statement and, further when he said he had NOT read it!

A blatant and utter lie from the prosecution Advocate.

Quite clearly Stuart was not going to win his appeal today. Did he ask for a 'recuse' on Pitchers?

How many people will really read Mr Power's statement if, and when it appears on the internet, or will they just scan over it and not take in the full 94 pages which I understand are quite revealing.

    Upwards and onwards.

    ReplyDelete
  141. Have received a phone-call from Stuart Syvret. He has asked that I convey to readers the he remains in high spirits and once again thanks people for their support.

He has asked (which fits in with the alleged perjury sketch) that those who doubt the lawlessness that he claims is prevalent in the case against him, that people try and find the time to get to the court and witness it for themselves.

He remains (as do others) of the view that he is a Political Prisoner and the case against him is illegal and politically motivated.

His next court case, he has been told, is on November the 25th although he doesn't know which court it is in, or what the case is about.

The people of Jersey have spoken.

And I would imagine his appearance on the 25th will be the start of the defamation suits. Let's face it there queuing up for there day in court.

  144. Not sure if you understand what a political prisoner is. You don’t have to be a politician in prison to be a political prisoner. You just need to speak out against a corrupt government/regime and they have you chucked in prison for all kinds of trumped up charges.

  145. Wouldn't Stuart be released at the half way point of his 8 wk sentence? Works like that in the UK.

With good behavior he should do two thirds of his sentence. Jersey as far as I’m aware, does not have Parole where he might only do half the sentence.

In keeping with the Child Abuse Cover-up this will be Sir Philip Bailhache.

He was our Bailiff and chief judge in 2008

He is the man who uttered these immortal words on May 9th 2008

"Hardly any of this has been beamed across the world. Yet many journalists continue to write about the Island's so called child abuse scandal. All child abuse, wherever it happens, is scandalous, but it is the unjustified and remorseless denigration of Jersey and her people that is the real scandal. The truth is that we do not yet know what happened at Haut de la Garenne or in other places. What we do know is that a rigorous investigation is taking place and, in due course, a balanced judgement will be possible. A brave writer in the Guardian earlier this week was the first journalist in a national newspaper, so far as I know, to confront this truth"

  158. This post contains a message to the troll, to VFC and to people who want to see an end to injustice in Jersey.

Is it really worth posting these anti-Syvret comments? This person holds Jersey Courts in high regard and doesn't have a grip on the facts.
To that person, please note- you're better suited to the farce blog which lacks international attention because it lacks credibility. You fit their audience profile better than ours. We differ because we share the view that-
Child abuse is wrong. Cover ups are wrong. The Jersey judicial system and many other Jersey authorities are corrupt and their treatment of whistle blowers is unacceptable.
There are other hindrances to our cause, such as Jersey's weak democratic political system, the shallow local media, the pervading fear, the uninformed youth, the patriarchal and divided society and the fragmentation of the middle and left ground. We are pleased that people around the world are demanding an end to corruption. We are no different and like them, our numbers will grow.
If Occupy London can form a university in 3 days, then after 3 years of blogging, I'm up for forming something constructive. I'd hope that in 6 - 8 weeks we would have met, formed, agreed our constitution and be setting our agenda. I'd hope we would be consensus driven, non violent, motivated and welcoming. Whether we call ourselves the Jersey Charter Party or Occupy Jersey, it doesn't really matter. What counts is that we do something positive. I believe now, with John Hemmings EDM, with SS in jail, with Nick Shaxon's book becoming a best seller, surely now is the time? The big question, does anyone else?

  160. The most serious indictment against democracy in Jersey is that otherwise intelligent people are not all outraged by the raid, arrest, suppression of evidence, and capricious prosecution of Stuart Syvret.

He was knowingly at risk of a jail term when he chose not to perform community service, but the undeniable point of his entire prosecution is that he has been singled out for malicious and unjust treatment in the first place. His staunchest critics should be defending his right to his basic human rights and free speech in the clear public interest.

Would his gleeful critics want Nurse M to treat them and their loved ones? Of course not. If they do not see his treatment as illegal, they are not supporters of democracy and human rights. have any of his critics read any evidence?

He's not a victim, he knew what he was doing, he's playing the long game where the odds on him succeeding in his quest, get better by the day. I'm very disappointed that the Jersey MSM failed to report the far bigger crime of perjury in a court and failed to acknowledge that a UK MP is seeking an investigation into the CORRUPTION in Jersey.

  169. Freedom of Speech is on Trial

Monday 14th November, 10 AM - Stonehaven Court, Aberdeenshire, Scotland.

Robert Green stands ALONE in a Stonehaven Court accused of "breach of the peace"
for reporting the TRUTH. If you can get there please attend your presence
and support is NEEDED in this landmark case.

I've just spoken to Robert, he didn't realise Stuart is in prison, which is hardly surprising due to that fact that paedophile computer experts are tampering with peoples social networking. Anyway, he knows now, so he will tell other people. Just like Stuart, the paedoscum are trying to get this good man in jail, and for the same reason, that he has blown the whistle on the abuse of children.

Please get to his trial if you can. I phoned him up to ask him if his team can provide house space and hot soup or something at Stonehaven for people who want to attend to lay a sleeping bag.

    ReplyDelete
  170. I told Robert that Stuart had been jailed for not doing the community service that the illegal court case had sentanced him to do. I told him that I had begged Stuart to do it, because I didn't want him to go to jail, but that Stuart had refused to do it, and that although Stuart is not a haughty man he could not do it as it would have been admitting he had done something wrong had he accepted the punishment.

How many more of these good people are they going to persecute before the decent people working in the prisons and the police and the probation officers ect ect decide enough is enough?

But all we can do is keep an account of all these wicked things that they do. All we can do is to continue to resist these wicked people. Justice is coming though, because despite all the gagging, all the mucking round with social networking, we are letting the world know about what is going on. They will never brush any of these things under the carpet.

    ReplyDelete
  171. As a political blog writer imprisoned partly because of what he wrote on his blog Stuart's name should certainly be submitted to the Threatened Voices website.

I would say to everyone here who supports Stuart to do that and help spread word of his plight to the wider global audience.

  173. Christopher Pitchers is right. I can confirm from years of personal experience in the secret family courts, plus testimonies of other people I have met who have also suffered judicial persecution and corruption that Stuart has indeed had the same treatment as many other people have had in the courts.

That's the problem though isn't it? The courts are corrupt as hell, that's why the Occupy movement is spreading like wildfire. It's not just about corporate greed, it is about sickening corruption.

the authorities claim Stuart is being dealt with fairly- bullsh*t I say.

Bail should have been granted to give him time to mount a proper appeal (2 wks not unreasonable)

on a quick look, there are several cases that can be cited where prison was resorted to only after a number of court appearences for breach of community service orders

JRC 156, JRC 185, JRC 200 can be viewed at jerseylaw.je, check for yourself, non of the above had medical mitigation, plenty of previous though.

did Stuart have access to the internet, from his cell, to aid his appeal?

    http://holliedemandsjustice-robertgreensblog.blogspot.com/

On Monday 14th November, my long-awaited trial begins in Stonehaven, 15 miles south of Aberdeen, on a Breach of the Peace chargeand is scheduled to last for two weeks. Already, with its 12 pre-trial hearings, I understand it has set something of a record in Scottish legal history.

My defence stands on the right of a journalist to publish both what he believes to be the truth and is in the public interest. Therefore, the case will have huge ramifications for freedom of the press and by extension, freedom of expression and should therefore be of genuine interest to all those who believe in a free and open democracy as distinct to those in positions of power who plot and conspire behind closed doors.

Everyone should be fully aware that the publicity campaign over the past three years has essentially been one of last resort. Anne Greig and her supporters have tried all possible legal means over the last eleven years to seek the justice Hollie so richly deserves, yet have been frustrated at every turn by a state-sponsored conspiracy to protect the influential culprits involved, even after the state accepted Hollie`s evidence by awarding her £!3,500 in compensation for her ordeals.

This case is most certainly not about me, but about Hollie, Anne and the other poor children who have undoubtedly suffered at the hands of this vile gang. It is also about a good man, Hollie`s beloved Uncle Robert, known to all as Roy, cruelly murdered in 1997, because he accidentally became a key witness to this horrific abuse and thus had to be silenced. The build up of evidence indicating his murder is compelling beyond reasonable doubt, compounded by the authorities` increasingly desperate and evasive efforts to continue to cover it up.

However, the trial is set to begin, a public hearing, at ten on Monday morning. I have been denied a jury trial, which is not a good sign, but with public support and the sheer strength of of evidence, let us hope that it is one of those rare moments when justice is seen to prevail in Scotland in this awful case.

Of course, the multiple crimes and indeed the campaign itself have nothing whatsoever to do with the little fishing port of Stonehaven. The only plausible reason for all the hearings taking place there is to make it as remote and difficult to get to for the public and media. Of course, if anyone can possibly come along, I would be delighted to see you.

Finally, may I just thank those many people from around the world who have been kind enough to send me letters of support for my legal team to pass to the sheriff. It is very much appreciated and I am so grateful.

    Robert
